BOOKING & SERVICE TERMS
These Booking & Service Terms apply only to creative services purchased directly through the Fearne Clementine 1789 website. They sit alongside the selected service page, its stated scope and the information you provide after purchase. They do not govern bespoke private-client commissions, retained work, work quoted separately or any project agreed by proposal, invoice or written contract outside this website.
What you are booking
Your order books the specific service, variants and add-ons selected at checkout. The product page describes the included scope, deliverables, timing and refinement allowance. The purchase price covers that stated scope only.
If the Studio reasonably considers that a request is not suitable for the selected service, is unlawful, infringes another party’s rights, is materially different from the information supplied, or cannot be delivered to the required standard, it may decline the booking. In that event, any payment taken for that booking will be refunded in full.
Beginning the work
Purchase reserves a place in the Studio’s schedule. Within one working day, you will receive an intake note setting out the materials, access, product information, imagery, copy and decisions needed to begin. Delivery timing starts only once these have been received in a complete and usable form.
Please provide all relevant information together where possible. The Studio may pause work, move a delivery date or return a booking to the schedule if essential information, feedback or access is delayed. If nothing needed to start has been provided within 30 calendar days, the booking may need to be rescheduled around current availability.
Scope, changes and additional work
A request beyond the purchased service is additional work. This includes a broader brief, more products, pages, formats or concepts than selected; a new direction after approval; additional refinement rounds; new deliverables; or work involving third parties, printing, development, implementation or ongoing management unless the service page expressly includes it.
The Studio will always explain any additional fee and timing before beginning that work. It will not be included simply because it is connected to the original idea.
Timing, feedback and approval
Timings are working-day estimates rather than guaranteed deadlines. They depend on prompt, clear communication and on the quality and completeness of the materials supplied. Delays caused by missing information, late feedback, changed instructions, third-party platforms or suppliers, or circumstances outside the Studio’s reasonable control may extend the timeline.
The refinement rounds included with your service are shown on its product page. Feedback must be consolidated, clear and submitted within the requested review window. Approval of a stage allows the work to progress; revisiting an approved stage or introducing a materially different direction may require a new quotation.
Fees and payment
All prices are shown in GBP. Fearne Clementine 1789 is not currently VAT registered, so VAT is not charged. Payment is taken at checkout and the Studio will not release final deliverables until payment has cleared in full.
Any external cost is excluded unless the relevant product page says otherwise. This includes printing, production, postage, website or platform fees, advertising spend, paid fonts, stock licences and third-party subscriptions.
Consumer cancellation and refunds
If you are buying as a consumer, you may have statutory cancellation rights for a distance service contract. Nothing in these terms limits those rights. You may notify the Studio that you wish to cancel by emailing fearneclementine@gmail.com with your name, order number and a clear statement that you wish to cancel.
The Studio will not begin work during an applicable cancellation period unless you make an express written request to start early. Where you make that request, you acknowledge that you may be responsible for a proportionate amount reflecting the work completed up to cancellation. Where the service has been fully performed following your express request, any cancellation right may be lost to the extent permitted by law.
For business customers, fees become non-refundable once work has begun, except where the Studio agrees otherwise in writing. A refund is never used to remove or transfer rights in work already supplied, but your statutory rights remain unaffected.
Client materials, approvals and permissions
You are responsible for ensuring that you have the right to provide and use every item you share with the Studio, including copy, images, logos, trade marks, product claims, packaging, data, credentials and access. You remain responsible for the final factual, legal, regulatory and commercial approval of any content before it is published, printed, produced or used.
The Studio may rely on the accuracy of the information you supply. It is not responsible for errors in client-approved copy, pricing, claims, product details, links, measurements, third-party data or permissions.
Contemporary tools and generated imagery
Where an imagery or image-generation option is selected, the Studio may use contemporary creative tools as part of a human-led process. Generated or third-party-sourced visual material can be subject to platform terms, technical variation and licensing conditions. It is supplied for the agreed creative purpose only and is not represented as exclusive, clearance-free or suitable for trade mark registration unless expressly confirmed in writing.
You are responsible for checking that any final use is appropriate for your sector, territory, platform and audience. The Studio does not provide legal, regulatory, advertising-clearance, accessibility, trade mark or intellectual-property advice.
Final files and intellectual property
Once payment has cleared, you receive a licence to use the final agreed deliverables for the original project and purpose described on the selected service page. The licence does not include unused concepts, research, drafts, working files, editable source files, templates, methods, processes, purchased licences or third-party assets unless the service page expressly says they are included or the Studio agrees otherwise in writing.
You may not resell, sublicense, reproduce as a template, train an AI system on, or claim authorship of the Studio’s working materials or unused concepts. Where a print-ready PDF is included, it is supplied for your own chosen printer; you remain responsible for checking proofs, specifications and production requirements before approving print.
Portfolio, confidentiality and communication
The Studio may show completed work, project imagery and publicly available outcomes in its portfolio, social channels, awards submissions and studio materials after the work has entered the public domain. If a project requires confidentiality or an agreed launch embargo, this must be stated in writing before materials are shared.
Project communication and feedback are handled in writing so that decisions remain clear and properly recorded. A call may be agreed separately where it is genuinely useful to the work, but it is not included unless stated on the relevant service page.
Outcomes and third parties
The Studio works with care, commercial awareness and considered judgement, but cannot guarantee sales, conversion, press coverage, rankings, audience response, platform approval, technical performance or any other commercial outcome. The final effect of creative work depends on factors outside the Studio’s control.
The Studio is not responsible for the performance, availability, changes, policies, delays or failures of printers, manufacturers, website platforms, social platforms, payment providers, ad platforms, suppliers or other third parties.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, the Studio’s total liability arising from a particular online booking will not exceed the amount paid for that booking. The Studio is not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data, business interruption or reputational loss.
Governing law and questions
These terms are governed by the laws of England and Wales. If anything about the selected service, your scope or these terms is unclear before purchase, please contact fearneclementine@gmail.com before placing your order.
